1. Acceptance of Terms

By accessing or using Wayfare ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Wayfare is a web-based trip planning application that allows users to create and manage trips, save locations using Google Maps, organize itineraries, split expenses among travel companions, create checklists, and track budgets. The Service is provided on an "as is" and "as available" basis and may be updated, modified, or discontinued at any time without prior notice.

3. User Accounts and Registration

You may access the Service by authenticating with a Google account or by using a guest session. When signing in with Google, you authorize us to access basic profile information (name and email address) for the purpose of creating and managing your account.

You are responsible for safeguarding your account credentials and for any activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. Guest sessions are temporary and do not create a persistent account.

You retain full ownership of all content you create, upload, or store through the Service, including but not limited to trip data, locations, notes, expense records, and checklists ("User Content"). We do not claim any intellectual property rights over your User Content.

By using the Service, you grant Wayfare a limited, non-exclusive, royalty-free license to store, process, and display your User Content solely for the purpose of providing and improving the Service. This license terminates when you delete your User Content or your account.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Wayfare and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

The Service integrates with third-party services including Google OAuth (for authentication) and Google Maps Platform (for location services). Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of any third-party services.

8. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may delete your account and associated data at any time through the Service.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

In no event shall Wayfare, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

You agree to defend, indemnify, and hold harmless Wayfare and its licensors, employees, contractors, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or your violation of these Terms.

12. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
